These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and Creative Lab Co., Ltd., a corporation incorporated under the laws of the Republic of Korea ("Company", "we", "us"), operator of the ClearAd platform at uk-ad.pages.dev ("Service").
By registering an account or otherwise using the Service you confirm that: (a) you are at least 18 years old; (b) you have full legal capacity to enter this agreement; and (c) you have read and accept these Terms in their entirety. If you do not agree, do not use the Service.
ClearAd provides AI-assisted compliance screening for advertising content against UK regulatory frameworks including: ASA/CAP Code, BCAP Code, MHRA Advertising Guidelines, GMC/NMC Standards, UK GDPR / ICO requirements, Online Safety Act 2023, and CMA guidelines.
All analysis output is provided for screening and reference purposes only. Specifically:
Paid subscriptions are billed in GBP (£), inclusive of applicable UK VAT where required. All payments are processed by Paddle.com Market Limited ("Paddle"), our authorised Merchant of Record. By subscribing you also agree to Paddle's Buyer Terms.
You agree not to:
Breach of this section may result in immediate account suspension and may attract civil or criminal liability.
All intellectual property in the Service — including software, AI models, UI design, brand assets, and documentation — is owned by or licensed to Creative Lab Co., Ltd. and is protected under applicable law.
You retain full ownership of the content you submit for analysis. By submitting content you grant us a limited, non-exclusive, royalty-free licence solely to perform the analysis requested. We will not use your submitted content to train AI models without your explicit written consent.
The Service is provided "as is" and "as available" without warranty of any kind. To the maximum extent permitted by law we disclaim all implied warranties including fitness for a particular purpose and non-infringement.
Screening tool disclaimer: ClearAd's AI outputs are compliance screening indicators only. We expressly disclaim all liability for any regulatory investigation, enforcement action, fine, penalty, reputational harm, or other loss arising from your reliance on ClearAd output — including but not limited to ASA adjudications, MHRA enforcement, FCA action, or ICO investigation — whether or not you consulted a legal professional.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of: (a) the total fees paid by you in the 12 months preceding the claim; or (b) £100. We are not liable for indirect, incidental, consequential, or punitive damages.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK or Korean law.
If you are a consumer in the United Kingdom, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, Consumer Contracts Regulations 2013, or any other applicable UK consumer protection legislation. Where any term conflicts with those rights, your statutory rights prevail.
You may terminate your account at any time via the account dashboard. We may terminate or suspend your account immediately if you materially breach these Terms or if required by law. On termination, your right to access the Service ceases. Sections 06, 07, 10 and 11 survive termination.
We may update these Terms at any time. We will notify you by email or prominent in-app notice at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
For UK-based consumers: These Terms are governed by the laws of England and Wales. Nothing in these Terms affects your statutory rights as a UK consumer under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, the Digital Markets, Competition and Consumers Act 2024, or any other applicable UK consumer protection legislation. Where any provision of these Terms conflicts with your statutory rights, your statutory rights shall prevail.
For non-UK users: These Terms are governed by the laws of the Republic of Korea, subject to any mandatory local consumer protection laws that may apply in your jurisdiction.
Before initiating formal proceedings, both parties agree to attempt resolution through good-faith negotiation. If unresolved within 30 days, UK consumers may bring proceedings in the courts of England and Wales. Non-UK users agree to submit to the jurisdiction of the courts of the Republic of Korea.
UK consumers also have the right to use alternative dispute resolution (ADR) schemes. For disputes relating to payments, you may also contact Paddle (our Merchant of Record) directly at paddle.net.
